Only if the Heartless was defeated before the Nobody. So, basically, anyone Nomura wants to bring back. Yep, I have heard though that sometimes there is an exception and the Nobody can be defeated first, but for now I'll just stick with the fact that the Heartless must be defeated first. Of course they are back, just think of all the heartless Sora have defeated. You do realize how much easier it is to produce a Heartless than it is to produce a Nobody, right? I mean, these things can even be manufactured. There's a higher chance that the Heartless of the rest of the Organization haven't been defeated.
