Chances are, if Fox didn't own X-men and X-men related movie rights, and Sony didn't own Spider-Man and Spider-Man related movie rights, they could appear in Avenger movies.

And regardless of that,my point is that Wolverine doesn't fit in the Avenger especially when most of his origins are closely tied to the X-Men There is a difference between "Hey,let us work together" and "Can I join and become a member of the Avengers" Cuz with that logic Deadpool can join the Fantastic Four and rename them into the Fantastic Five I'm pretty sure they've appeared in comics together. There is a difference between working together and becoming an official Avengers member

Most major Marvel characters probably have been. Although I think Wolverine was the only X-men character to join the Avengers. I personally would love for the new Spider-man and Wolverine to team up with the Avengers although I really doubt that would happen considering the ownership rights and such.
